TIME + MONEY
Payments
Payment is accepted in US Dollars ($) via a mailed check or PayPal. Checks can be made out to "Tara Tierney" and I will provide my address. You do not need a Paypal account to use a credit card.
Payments are generally broken down into 2 installments: 50% upfront upon booking, 50% once everything is completed and approved, or within 30 days of booking (please see your project proposal for details). All payments are due in full before your website is launched and before I send you any final design files. Payment plans are available for my branding + website packages. Submitting any money to me means you have read and fully accept the design terms and conditions listed on this page.
Submission of final balance indicates satisfaction with work completed. No changes will be made after the final payment is submitted as the project will be considered complete. If you would like to make updates or changes to anything after your project is complete, please feel free to inquire about my website maintenance packages.
Remaining Balances
When all the agreed-upon work for your project is completed, you will be required to make your final payment before receiving any final files or before your website goes live. If final payment is not received within 5 calendar days of the due date, a late fee of 5% will be applied to your final balance and will be applied every 30 days until the payment is paid in full.
After 90 days of outstanding payment, Tara Tierney reserves the right to send you to collections, upon which you will owe the total amount of any outstanding payments plus any additional late fees and collection costs, including reasonable attorney’s fees.
Refunds
Due to the nature of my business (digital products and online services), there are no refunds given at any time, which you are responsible for understanding upon providing a deposit and any other payments to me.
Rescheduling
I take on a limited amount of projects at a time to ensure each of my clients receives the attention to detail and energy needed to accomplish all work in a timely manner and at the highest quality possible. Some projects take 2-12 weeks on average to complete, which includes time getting to know you, your style, your goals, communication back and forth, doing research, designing, building, revising, launching, and testing.
That being said, if most of the content is not prepared and ready for me by your start date, I may have to reschedule your project until a later date, which could result in a rescheduling fee of $500. The new date will depend on my current schedule and how many other client projects I have booked out.
Revisions
You will have 2 rounds of revisions included per design concept. This is included for each individual branding element as well as the presentation of your website.
If additional rounds of revisions are needed or if you need to make changes or additions that are outside the initial scope of the project, you will be charged for the extra time at my hourly rate of $65/hour for graphic design or $100/hour for website design. We will talk about the details before I move forward with any additional work.
Canceling the Project
Sometimes the designer/client relationship doesn't quite work out as expected or something else in life comes up. Whatever the reason, if either of us decide we'd prefer/need to cancel the project, we each reserve the right to do so.
In this event, a full refund will be issued, minus the hours of work I've already completed at the time of cancellation.
Please note, that building a brand or website requires quite a bit of upfront work, which includes communication with the client, doing research, and coming up with concepts and ideas. That being said, a refund amount will be based on the time I've already spent working on the project. If any design concepts were created, they will remain my property but will be available if the project should be resumed at a later time (within 1 year).
In addition, I reserve the right to cancel projects that become lengthy or burdensome. I also reserve the right to refuse service if I feel disrespected or if your requirements are not quite the right fit for my service structure.
This cancellation does not include blog/site hosting and domain registration, as they are set up through a third-party vendor.
COMMUNICATION
How We Will Communicate
Most communication will be done via Asana, the project management system I use to organize and each of my client's design projects. Asana allows us to share concepts and files with each other, organize the design process, and make sure we stay on track every step of the way. If you ever feel you need some extra support during your project's timeline, we can also jump on the phone or do a video call.
My Availability
I will be available Monday to Friday 9am-6pm to work on your project, communicate with you and provide support however you need it. This includes answering questions, offering business advice, being a sounding board to bounce ideas off of and basically guiding and educating you from start to finish.
CLIENT RESPONSIBLITIES
Your Availability
Once we begin, you agree to make yourself available for edits, revisions, and feedback each week until completion. If your response is delayed, your project may also be delayed. If you know you will be unable to do this (ie: you're planning a vacation) then please provide this information with me before your start date.
Website Content
It will be your responsibility to provide a majority of the content that goes on your website, including the copy for each of your pages (what you want written,) any photos you'd like to use, etc.
If you'd like to use stock photos on your site, I will be happy to assist you in finding them (using both free and premium resources.) Please be aware that you will be responsible for purchasing any premium stock photos we choose to use on your site.
Graphic Files
Although I do try to save your graphic files for possible future updates, I cannot be held responsible for files that are lost or damaged and claim no responsibility for file storage. I will share your final files with you on Google Drive and recommend that you download them immediately to your own computer so that you always have them available. Files may be deleted off of Google Drive after 90 days.
Printing + Shipping
You will be responsible for printing and shipping your business cards, marketing collaterals, etc. If you would like me to handle this for you, feel free to inquire for an additional quote.
Website Maintenance
Once your final deposit is received, you take full responsibility for your website and all of its files, components, and backups. All your website backup and file management should be done through your web hosting company and it's recommended that you backup your website often (I recommend adding daily, automated backups by purchasing the site lock option through Bluehost).
It will also be your responsibility to manage and maintain your website once it is completed, which includes keeping your themes and plugins up to date. This is essential as it helps protect your site against hackers and helps keep your site functioning the way it was designed to function.
Please keep the contact information of your site host handy, in case you experience any technical disruptions to your site. You will need to contact them. Tara Tierney is not responsible for server downtime, software issues, or compatibility issues that may arise after the launch of the site, as these are the responsibility of your website's hosting provider. If your website or blog happens to get hacked or otherwise compromised, Tara Tierney cannot be held responsible.

AUTHORIZATION
Authorization
You are required to provide access to any FTP, hosting, domain, and/or WordPress account information along with usernames and passwords for the sole purpose of installing, configuring, developing and testing the website. In certain instances, usernames and passwords for other accounts may need to be provided in order to access special features on your website. I will never share your usernames or passwords with anyone at anytime.
Passwords
After your website is complete, I strongly recommend that you change any passwords that have been shared with me. This includes: domain registrar, hosting, email and wordpress logins.
Ownership of Files, Content, Images, Documents and Videos
It is your responsibility to ensure you have the right to use any and all files, content, images, documents, videos and any other items you provide to me for any project. You must make sure that you have full ownership of any content in any format before sending it to me. Tara Tierney is not liable or responsible for any copyright or ownership issues for files, content, image, document, videos or other items used for any project.
Usage of Web Materials
Tara Tierney is allowed to use any created work or related items for her own promotional materials. Any created work may appear on her Portfolio page, Facebook page, or any advertisements in print or online.
TECHNICAL STUFF
Browser Compatibility
Tara Tierney does not guarantee that your site will render the same on all browsers. Website are designed primarily for Google Chrome, Safari and Firefox and it is recommended that you use the latest version of one of these browsers for optimal viewing.
Contact Forms
Tara Tierney is not responsible for changes in email settings or other lapses in plugin or server communication, nore is she to be held responsible for loss of profit or traffic due to contact form issues. It is your responsibility to periodically test your contact forms to make sure you are receiving your messages.
DESIGN ASPECTS
Mobile Theme
Your site design will be responsive or "mobile-friendly." Please keep in mind that a mobile theme is NOT your full website design. It is simplified for tablets and mobile devices. I understand that clients generally hire me to create cool-ass sites, but please understand that for your website to appear mobile-friendly to Google, some of your custom design elements may not be visible on the mobile version only. This has nothing to do with the designer or the design, it is due to very strict Google policies on text and graphic appearance.
Website Design Credit
Tara Tierney is allowed to add a Website Design credit to the bottom of your website. This credit will say “Site designed with love by Tara Tierney” with a link to her website.
Please let me know if you do not want this credit at the bottom of your site.
